Terms of Service

1. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use Bite Chaser. If you use Bite Chaser on behalf of a business or other entity, you represent that you have authority to bind that business or entity to these Terms.

2. Your Account

You are responsible for providing accurate information, keeping your login credentials secure, and all activity that occurs under your account. Bite Chaser may suspend, restrict, or terminate accounts that contain false information, violate these Terms, create payment risk, create safety risk, or create legal, operational, or trust concerns.

3. Platform Role

Bite Chaser is a technology platform designed to help food trucks, customers, and venues connect around discovery, menus, live location, events, catering, ordering, P.O.S., rewards, receipts, and related services.

Unless Bite Chaser expressly states otherwise for a specific feature, Bite Chaser is not the employer, agent, joint venturer, restaurant, food preparer, food seller, venue operator, health department, tax advisor, insurer, or guarantor of any truck owner, venue partner, customer, order, event, catering request, menu, ingredient, allergen statement, review, or business outcome.

4. Customer Orders, Events, And Catering

Customers may use Bite Chaser to discover trucks, view menus, follow trucks, request catering, submit event requests, place eligible order-ahead purchases, receive receipts, and use customer portal features where available.

Food trucks are independent businesses responsible for food preparation, ingredients, allergens, sanitation, menu accuracy, item availability, pickup timing, order fulfillment, permits, taxes, insurance, customer service, and legal compliance.

Customer event and catering tools help customers and trucks communicate. Bite Chaser does not guarantee that a truck will accept, quote, attend, cater, or complete an event or catering request unless a separate confirmed agreement or checkout states otherwise.

5. Truck Owners And Venue Partners

Truck owners and venue partners remain responsible for their own operations, permits, food handling, staffing, scheduling, site rules, taxes, insurance, safety, and legal compliance. Truck payment and operating features may require a separate Truck Operating Agreement. Venue features may require venue-specific terms or checkout disclosures.

6. Paid Services And Billing

No Bite Chaser monthly software plan is currently required for owner portal access. Some Bite Chaser activity may still involve paid transactions, checkout fees, catering fees, hardware-related charges, historical billing records, or other fees clearly shown at the time of purchase, checkout, or account setup.

If Bite Chaser later offers an optional recurring paid product, or if a historical recurring billing record remains active for your account, you authorize Bite Chaser and its payment processor to charge your selected payment method on a recurring basis until you cancel, subject to the pricing and billing terms shown in the applicable checkout or billing flow.

7. Taxes, Fees, Tips, And Payments

Checkout may include food subtotal, truck-set sales tax, optional tip, Bite Chaser Convenience Fee, Bite Chaser Technology Fee, Bite Chaser Catering Fee, payment-provider fees where applicable, event or catering charges where applicable, discounts, refunds, and total amount due.

Truck owners are responsible for setting and maintaining legally correct tax settings for their business, collecting and remitting taxes where applicable, filing required returns, and staying compliant with tax laws and regulations that apply to their operations. Bite Chaser does not provide tax advice and does not guarantee that a truck tax setting is legally correct.

Bite Chaser may rely on Stripe or other payment providers. Payment methods, authorization, capture, refunds, disputes, card-present payments, card-reader payments, and related payment features may be subject to provider terms, provider availability, fraud review, and account status.

8. Cancellation, Refunds, And Credits

If you are enrolled in any optional recurring paid product or historical recurring billing record, you may cancel it through the methods Bite Chaser makes available at the time. Unless Bite Chaser states otherwise for a specific purchase, cancellation stops future renewals and does not automatically create a refund.

Except where required by law or expressly approved by Bite Chaser in writing, Bite Chaser fees are non-refundable after payment. A food, P.O.S., order-ahead, schedule-later, or catering refund may exclude the Bite Chaser Convenience Fee, Technology Fee, Catering Fee, or other platform fee even when the food or truck-controlled portion is refunded. Payment-provider processing fees, Stripe fees, card network fees, dispute costs, and other provider costs may also be non-refundable or excluded from any refund where provider rules allow.

Food order and catering refunds for the food or truck-controlled portion are at the discretion of the truck, subject to applicable law, payment-provider rules, Bite Chaser platform policy, and the facts of the issue. Refund eligibility may depend on order status, truck preparation, pickup timing, customer pickup, truck response, fraud review, and payment-provider rules.

Orders are ineligible for truck-issued in-app refunds past the date of payout to the truck. Once payout for an order has been sent or recorded, the standard refund button or in-app refund workflow may no longer be available, and any remaining issue may require separate review or resolution outside the normal in-app refund flow.

9. Allergens And Food Safety

Customers with allergies, dietary restrictions, medical conditions, or ingredient concerns must verify details directly with the truck before ordering or consuming food. Bite Chaser may display menu information submitted by trucks, but Bite Chaser does not independently verify ingredients, allergens, cross-contact, preparation methods, or food safety practices.

10. User Content

You may submit content to Bite Chaser, including profile information, truck details, menus, photos, listings, messages, reviews, event information, venue details, catering details, and support details. You retain ownership of your content, but grant Bite Chaser a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, distribute, promote, and use that content as needed to operate, improve, market, support, and protect Bite Chaser.

11. Prohibited Conduct

• Use Bite Chaser for unlawful, fraudulent, abusive, unsafe, or deceptive activity.
• Impersonate another person, business, truck, venue, or representative.
• Interfere with the platform or attempt unauthorized access.
• Upload malicious code or harmful content.
• Post false reviews, false event requests, false venue listings, or false business information.
• Use Bite Chaser in a way that damages the platform, other users, or Bite Chaser's brand and trust.

12. Support Boundaries

Bite Chaser support may collect information, route issues, provide status updates, and help coordinate platform issues. Support intake does not guarantee a refund, cancellation, account change, order correction, truck action, venue action, legal result, tax result, or immediate response.

Do not send payment card numbers, passwords, full government IDs, medical details, or other sensitive information through support messages unless Bite Chaser provides a secure approved channel.

13. Third-Party Services

Bite Chaser may rely on third-party services such as Firebase, Stripe, Mapbox, analytics providers, email providers, hosting providers, security providers, Apple, Google, and other service providers. Your use of those services may also be governed by their terms and policies.

14. Disclaimers And Limitation Of Liability

Bite Chaser is provided on an "as is" and "as available" basis to the maximum extent allowed by law. Bite Chaser disclaims all warranties, express or implied, including implied warranties of availability, accuracy, merchantability, fitness for a particular purpose, title, and non-infringement.

To the maximum extent permitted by law, Bite Chaser and its affiliates, owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-revenue, lost-customer, lost-goodwill, lost-data, personal-disappointment, reputational, or lost-opportunity damages arising out of or related to your use of Bite Chaser.

15. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or Bite Chaser will be brought exclusively in the state or federal courts located in Tennessee, unless applicable law requires otherwise.

16. Changes To These Terms

Bite Chaser may update these Terms from time to time. If we make material changes, we may update the effective date and provide notice through the platform or by other reasonable means. Your continued use of Bite Chaser after updated Terms become effective means you accept the updated Terms.
