These Terms of Service govern your access to and use of the Bite Chaser website, applications, products, and services. By accessing or using Bite Chaser, creating an account, or purchasing a paid service, you agree to these Terms.
You must be at least 18 years old and able to enter into a binding agreement to use Bite Chaser. If you use Bite Chaser on behalf of a business or other entity, you represent that you have authority to bind that business or entity to these Terms.
You are responsible for providing accurate information, keeping your login credentials secure, and all activity that occurs under your account. Bite Chaser may suspend or terminate accounts that contain false information, violate these Terms, or create legal, operational, or trust risk.
Bite Chaser is a platform designed to help food trucks, customers, and venue partners connect around discovery, events, catering, ordering, and related services.
Unless Bite Chaser expressly states otherwise for a specific feature:
Some Bite Chaser features are free and some are paid. Paid features may include recurring subscriptions, add-ons, posting fees, venue fees, service fees, or other fees clearly shown at the time of purchase.
If you enroll in a recurring plan, you authorize Bite Chaser and its payment processor to charge your selected payment method on a recurring basis until you cancel, subject to the pricing and billing terms shown in the applicable checkout or billing flow.
You may cancel a recurring paid plan through the methods Bite Chaser makes available at the time. Unless Bite Chaser states otherwise for a specific purchase, cancellation stops future renewals, does not automatically create a refund, and may allow paid access to continue through the end of the current paid billing period.
Except where required by law, Bite Chaser fees are non-refundable.
If a paid Bite Chaser event post is not fulfilled through the platform, Bite Chaser will issue one replacement event-post credit instead of a cash refund, subject to reasonable verification by Bite Chaser. Replacement event-post credits are issued to the original account, are non-cash and non-transferable, and may be used only for a future qualifying event post on Bite Chaser.
You may submit content to Bite Chaser, including profile information, truck details, menus, photos, listings, messages, reviews, event information, venue details, and other materials. You retain ownership of your content, but you grant Bite Chaser a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, format, and use that content as needed to operate, improve, promote, and provide the platform.
Bite Chaser may rely on third-party services such as Firebase, Stripe, Mapbox, analytics providers, and security providers. Your use of those services may also be governed by their terms and policies.
Bite Chaser is provided on an "as is" and "as available" basis to the maximum extent allowed by law. Bite Chaser disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by law, Bite Chaser and its affiliates, officers, owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunity, or reputation arising out of or related to your use of Bite Chaser.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or Bite Chaser will be brought exclusively in the state or federal courts located in Tennessee.
Bite Chaser may update these Terms from time to time. If we make material changes, we may update the effective date and provide notice through the platform or by other reasonable means. Your continued use of Bite Chaser after updated Terms become effective means you accept the updated Terms.
