Operating Agreements
These role-specific agreements explain how customers, food truck owners, and venues use Bite Chaser. The version shown and accepted in the app is preserved with the signed account record.
Bite Chaser no longer requires a monthly software subscription for truck or venue access. Current agreements reflect free truck access, free venue posting, free event and catering requests, Stripe-connected payments, non-refundable Bite Chaser platform fees except where required by law or expressly approved in writing, truck-controlled refund discretion, and the post-payout in-app refund cutoff.
Customer Terms And Ordering Addendum
By creating an account, using Bite Chaser, placing an order, requesting catering, submitting an event request, following a truck, reviewing a truck, or using customer features, the customer agrees to Bite Chaser's Terms of Service, Privacy Policy, Refund Policy, this Customer Terms and Ordering Addendum, and any checkout-specific disclosures shown in the app.
Bite Chaser provides software, discovery, menu, live-location, order-ahead, event, catering, rewards, messaging, payment, receipt, support, and marketplace tools. Bite Chaser is not a restaurant, food seller, food preparer, health department, delivery service, tax advisor, insurer, or guarantor of any truck, venue, event, catering request, menu, ingredient, allergen statement, review, pickup time, or business outcome.
Customer responsibilities
- Review the truck, menu items, pickup location, pickup timing, contact information, allergens, and total amount before checkout.
- Be present at the stated pickup location and follow pickup instructions shown in the app.
- Verify allergy, dietary, medical, and ingredient concerns directly with the truck before ordering or consuming food.
Fees, refunds, and payment
Checkout totals may include food subtotal, truck-set sales tax, optional tips, Bite Chaser fees, payment-provider fees where applicable, event or catering charges where applicable, discounts, refunds, and other amounts shown before payment.
Order-ahead and schedule-later checkout may include the Bite Chaser Convenience Fee, currently 5% of the food subtotal capped at $2.49. P.O.S. card-reader checkout may include the Bite Chaser Technology Fee, currently 2% of the food subtotal capped at $0.99. Accepted catering quotes may include the Bite Chaser Catering Fee, currently 5% of the catering quote subtotal capped at $99. If a Bite Chaser fee applies to the customer, it will be shown before payment and on the receipt. If no separate fee line appears, the customer is not being charged a separate Bite Chaser fee for that checkout.
Bite Chaser fees are non-refundable after payment except where required by law or where Bite Chaser expressly approves otherwise in writing. Food order and catering refunds for the food or truck-controlled portion are at the discretion of the truck, subject to applicable law, payment-provider rules, Bite Chaser platform policy, and the facts of the issue. Orders are ineligible for truck-issued in-app refunds past the date of payout to the truck.
Truck Operating Agreement
The truck operator represents that they are at least 18 years old, have authority to bind the food truck business or operator account identified in Bite Chaser, and that their typed name is their electronic signature when accepting the agreement in the app.
Bite Chaser provides software, marketplace, discovery, menu, live-location, ordering, P.O.S., scheduling, event, catering, venue-opportunity, messaging, analytics, receipt, Stripe Connect, Stripe Terminal reader support, support, and related platform tools. Bite Chaser is not the truck's employer, agent, joint venturer, franchisor, insurer, tax preparer, accountant, attorney, food safety manager, permit holder, payroll provider, delivery provider, or business operator.
Truck responsibilities
- Permits, licenses, health department requirements, vending permissions, venue permissions, insurance, tax settings, and legal compliance.
- Food preparation, food quality, ingredients, allergens, sanitation, menu accuracy, pricing, item availability, staffing, order fulfillment, customer service, refunds, disputes, and chargebacks caused by the truck.
- Keeping Go live, public location, order-ahead, and public availability accurate, including turning live mode off when service ends or when the truck should not be public.
Access, payments, and fees
No Bite Chaser monthly software plan is currently required for owner portal access. Truck accounts may use discovery, public profile, menu and live information, event marketplace, catering requests, venue opportunities, order-ahead, P.O.S., analytics, Stripe Reader M2 setup, Stripe Terminal reader flows, and other operating tools where available.
Stripe Connect onboarding, payout readiness, tax settings, supported card-reader setup, and any required payment-provider approvals may still be required before a truck can accept card payments, receive payouts, or use payment-dependent features.
Order-ahead and schedule-later checkout may use the Bite Chaser Convenience Fee, currently 5% of the food subtotal capped at $2.49. P.O.S. card and reader checkout may use the Bite Chaser Technology Fee, currently 2% of the food subtotal capped at $0.99. Accepted catering quotes may use the Bite Chaser Catering Fee, currently 5% of the catering quote subtotal. Trucks may choose whether certain Bite Chaser fees are shown as separate customer-paid lines, covered from the truck payout, or included in menu or quote pricing without a separate customer fee line.
The truck is economically responsible for Stripe, Stripe Connect, Stripe Terminal, Stripe Reader M2 or other supported reader hardware, card network, processing, reader, chargeback, refund, reversal, negative-balance, and payment-provider costs tied to the truck's payments or account. Bite Chaser may recover or offset applicable costs from settlement, payout, account balance, future payments, billing records, or other lawful reconciliation methods allowed by provider rules.
Refunds and payout cutoff
Subject to applicable law, payment-provider rules, Bite Chaser platform policy, and any required Bite Chaser review, the truck has discretion to approve, deny, replace, credit, or otherwise resolve customer refund requests for the food, P.O.S., order-ahead, schedule-later, catering, or other truck-controlled portion of an order.
Orders are ineligible for truck-issued in-app refunds past the date of payout to the truck. Once payout for an order has been sent or recorded, Bite Chaser may disable the standard refund button or in-app refund workflow for that order.
Venue Partner Agreement
The venue signer represents that they are at least 18 years old, have authority to bind the venue or event account identified in Bite Chaser, and that their typed name is their electronic signature when accepting the agreement in the app.
Bite Chaser provides software, discovery, listing, event, scheduling, communication, venue-opportunity, support, and marketplace tools that may help venues, organizers, food trucks, and customers connect. Bite Chaser is not the venue's agent, broker, property manager, event producer, insurer, security provider, permit holder, food safety authority, alcohol authority, tax advisor, legal advisor, or guarantor of any truck, customer, event, permit, sale, attendance, weather, public turnout, or business outcome unless Bite Chaser signs a separate written agreement that expressly says so.
Venue responsibilities
- Authority to use, list, and host activities at the location.
- Property access, parking, truck placement, utilities, restrooms, sanitation, trash, lighting, safety, security, crowd management, site rules, and neighboring-property impacts.
- Permits, licenses, zoning, fire, health, alcohol, noise, occupancy, public-street, traffic, police, emergency-service, vendor, event, insurance, and legal compliance obligations.
- Accurate venue rules, arrival instructions, load-in and load-out instructions, service windows, power or water availability, cancellation details, expected attendance, public/private access, and weather or site restrictions.
Free posting and optional paid features
Venue account access and standard venue opportunity posting are currently free. Bite Chaser may later offer optional paid promotional placements, sponsorships, premium services, or add-ons only when those charges are clearly disclosed before purchase.
Bite Chaser does not guarantee that any truck will apply, accept, attend, remain for the full event, meet sales expectations, satisfy all venue rules, or generate customer traffic. The venue is responsible for confirming event details directly with selected trucks where operationally necessary.
